“AN ACT GRANTING PATERNITY LEAVE OF SEVEN (7) DAYS WITH FULL PAY TO ALL MARRIED EMPLOYEES IN THE PRIVATE AND PUBLIC SECTORS FOR THE FIRST FOUR (4) DELIVERIES OF THE LEGITIMATE SPOUSE WITH WHOM HE IS COHABITING AND FOR OTHER PURPOSES”
Paternity Leave Requirements:
-Must be employed when the baby was born
-Must have a pregnant wife, has given birth or had a miscarriage
-Legally married with the pregnant wife
-Must be living with the pregnant wife under one roof
-Childbirth and miscarriage must not happen four times
-Properly inform your employer about the information that needs to be provided
How To File For Paternity Leave:
-Inform your HR Department about your wife’s pregnancy information such as the expected due date
-Fill out a Paternity Notification Form (Form will be provided by the employer)
-Submit a photocopy of the marriage certificate and submit it associated with the form

-Fathers can choose if they wanted to avail themselves their leave before or after their wife gives birth. They can split their leaves and it should only be 7 days. Paternity Leave will not be valid anymore 60 days after the child’s delivery date

-Unfortunately, paternity leave is not convertible to cash.
What if my employer refuses to give me paternity benefits?
-If your employer denies your paternity leave talk to your HR first, but if your leave got denied again file a complaint directly to DOLE
